This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("you," "your," or "User") and Ontario Golden Falls Casino LTD ("we," "us," "our," or "Ontario Golden Falls Casino") governing your download, installation, access to, and use of Ontario Golden Falls Casino (the "Application"), including any updates, upgrades, features, content, documentation, or related services made available through the Application.
Please read this Agreement carefully before downloading, installing, accessing, or using the Application. By downloading, installing, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to this Agreement, you must not download, install, access, or use the Application.
1. Purpose of the Application
Ontario Golden Falls Casino is a free, play-for-fun social casino application for iPhone. It offers 368 simulated slot machines from six studios, free demo play, daily and weekly challenges, a daily bonus wheel, Falls Reels (a simulated five-reel house slot), and progress tracking with statistics.
The Application is intended solely for the purposes described above and for lawful use.
The Application does not provide real-money gambling. The Application does not:
- accept real-money wagers or bets;
- accept deposits for gameplay;
- permit cash withdrawals;
- award cash prizes or cryptocurrency;
- provide financial rewards or redeemable prizes;
- operate a purchasable or redeemable virtual currency;
- allow users to purchase virtual chips, tokens, credits, or coins for gameplay;
- allow users to cash out simulated game results; or
- provide anything of monetary value based on gameplay outcomes.
Any game-style mechanics, graphics, terminology, reels, symbols, jackpots, bonuses, spins, tables, cards, or similar elements are simulated and provided solely for entertainment.
2. License Grant
Subject to your compliance with this Agreement, Ontario Golden Falls Casino LTD grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the Application on a compatible device that you own or control.
The license is granted solely for personal use, lawful use, non-commercial use, and entertainment purposes. The Application is licensed, not sold. This Agreement does not transfer ownership of the Application or any intellectual-property rights to you. All rights not expressly granted under this Agreement are reserved by Ontario Golden Falls Casino LTD and its licensors.
3. Eligibility
You may use the Application only if you satisfy the applicable minimum-age requirement.
The minimum age for use of the Application is 19 (the legal gambling age in Ontario, Canada). If your jurisdiction requires a higher minimum age for access to content or features of this kind, you must meet that higher age requirement.
By using the Application, you represent and warrant that you satisfy the applicable minimum-age requirement, you have legal capacity to enter into this Agreement, and your use of the Application is permitted under the laws applicable to you. The Application is not directed to children.
4. No Real-Money Gambling
The Application does not provide a real-money gambling service.
You cannot use the Application to place a real-money bet or wager, deposit money for gaming, withdraw money, receive real-money winnings or prizes of monetary value, exchange gameplay results for money or property, purchase gambling credits, transfer gambling balances, or participate in real-money gambling through Ontario Golden Falls Casino LTD.
Any simulated wins or losses have no monetary effect. The Application should not be considered a gambling operator, casino operator, sportsbook, lottery operator, financial platform, payment service, or wagering service.
5. Play-for-Fun Coins
The Application displays play-for-fun coins and experience as part of the simulated gameplay experience. Coins are earned only by playing, completing challenges, and claiming the daily bonus.
Coins and experience shown in the Application:
- are part of the simulated gameplay experience;
- have no real-world monetary value;
- cannot be purchased from us, sold, withdrawn, or transferred;
- cannot be redeemed for money or goods;
- do not constitute property; and
- do not create any payment obligation.
6. Demo Game Results
All games made available through the Application are intended to be demo, simulated, or entertainment experiences. Gameplay outcomes do not create entitlement to money, prizes, compensation, property, cryptocurrency, credits, cash equivalents, or any other item of monetary value.
Success in simulated gameplay does not indicate or guarantee success in any real-money equivalent. Demo-game odds, mechanics, probabilities, bonus frequencies, volatility, payout simulations, or other mathematical characteristics may differ from real-money versions of similar games. 7. Third-Party Games and Content

Unless expressly stated otherwise, Ontario Golden Falls Casino LTD does not own, operate, or control independent third-party games. Third-party games may be subject to separate terms of use, license agreements, privacy policies, cookie policies, or technical requirements. You are responsible for reviewing any applicable third-party terms before using third-party content.
8. License Restrictions
Except where expressly permitted by applicable law, you must not:
- copy, reproduce, distribute, sell, rent, lease, or sublicense the Application;
- commercially exploit the Application;
- modify, adapt, or translate the Application;
- create unauthorized derivative works;
- reverse engineer, decompile, or disassemble the Application;
- attempt to derive source code;
- bypass digital rights management, authentication, or security controls;
- disable technical protections;
- circumvent geographic restrictions;
- remove proprietary, copyright, or trademark notices;
- access non-public portions of the Application without authorization; or
- use the Application in a way that violates applicable law.
Nothing in this section limits rights that cannot lawfully be restricted under applicable law.
9. Prohibited Use
You must not use the Application to violate any applicable law, facilitate illegal activity, distribute malware or introduce malicious code, conduct a cyberattack, interfere with servers or networks, gain unauthorized access to systems, exploit security vulnerabilities, impersonate another person, engage in fraud, interfere with another user's use of the Application, scrape the Application at an abusive scale, circumvent rate limits, manipulate technical systems, copy substantial portions of our content or databases, attempt to misrepresent simulated gameplay as real-money gambling, or use the Application for an unauthorized commercial purpose.
10. Ownership
The Application and all original elements of the Application remain the property of Ontario Golden Falls Casino LTD or its licensors. Protected elements may include software, source code, object code, databases, user interfaces, design, layout, graphics, icons, illustrations, text, branding, logos, trademarks, documentation, audiovisual content, directory structure, compilations, and other proprietary materials.
The Application may contain third-party intellectual property that remains owned by the applicable third-party rights holder. No rights are granted to you except the limited license expressly provided in this Agreement.
11. Trademarks
Ontario Golden Falls Casino, related logos, branding, design elements, and other marks associated with us may be trademarks or trade names of Ontario Golden Falls Casino LTD. You may not use our trademarks without prior written authorization, except where applicable law permits such use.
Third-party trademarks appearing within the Application remain the property of their respective owners. The appearance of a third-party trademark does not necessarily indicate endorsement, affiliation, sponsorship, or partnership.
12. Application Updates
We may provide updates, upgrades, patches, bug fixes, new versions, or other modifications to the Application. Updates may correct errors, improve performance, address security issues, add or remove functionality, modify existing features, change compatibility requirements, or update third-party integrations.
Certain updates may be installed automatically depending on your device or application-store settings. Your continued use of the Application after an update may require acceptance of updated terms. We do not guarantee that any particular feature or previous version will remain available indefinitely.
13. Compatibility
The Application is designed for iPhone devices running iOS 16.0 or later, in portrait orientation. We do not guarantee compatibility with every device or operating-system version. Changes by device manufacturers, operating-system providers, browser providers, application stores, or other third parties may affect Application functionality.
14. Internet Connection
Some features of the Application, including game cover images and demo play, require an active internet connection. You are responsible for internet access, mobile data, network availability, data charges, and telecommunications fees. We are not responsible for charges imposed by your mobile network operator or internet service provider.
15. Application Store Terms
If you download the Application through a third-party application marketplace, your use of the Application may also be subject to that marketplace's terms and policies. Where mandatory application-store terms apply, those terms will apply in addition to this Agreement. If there is a direct conflict between this Agreement and mandatory application-store requirements, the mandatory requirements will apply to the extent of the conflict.
16. Apple App Store Terms
If you obtained the Application through the Apple App Store, the following additional provisions apply. You acknowledge that this Agreement is between you and Ontario Golden Falls Casino LTD, and not Apple Inc. ("Apple"). Ontario Golden Falls Casino LTD, not Apple, is responsible for the Application and its content, subject to applicable law.
The license granted to you is limited to a non-transferable license to use the Application on Apple-branded products that you own or control, subject to Apple's applicable usage rules and any permitted family-sharing arrangements.
To the extent required under Apple's applicable rules: Apple has no obligation to provide maintenance or support services for the Application; Ontario Golden Falls Casino LTD is responsible for addressing claims relating to the Application; Ontario Golden Falls Casino LTD is responsible for investigating claims that the Application infringes third-party intellectual-property rights; Apple is not responsible for the Application's content; and Apple and its subsidiaries may be third-party beneficiaries of the provisions of this Agreement applicable to distribution through the Apple App Store. Upon your acceptance of this Agreement, Apple may have the right to enforce those applicable provisions as a third-party beneficiary.

We may determine the types of support provided, support availability, communication methods, response procedures, and supported versions of the Application. Unless otherwise required by law, we are not obligated to provide indefinite support for outdated versions.
18. Privacy
Our collection and processing of personal information associated with the Application are described in our Privacy Policy, available at https://ontgoldenfallscasino.com/privacy.
You should review the Privacy Policy before using the Application.
19. Data Deletion
Where applicable, you may request deletion of personal information processed by Ontario Golden Falls Casino LTD in connection with the Application. Requests may be submitted to support@ontgoldenfallscasino.com.
The Application does not require user accounts, so there is no account to delete. Your gameplay progress is stored locally on your device and can be deleted at any time by choosing Reset progress in the Application's Settings or by uninstalling the Application. However, you may still request deletion of personal information we can reasonably associate with you, subject to applicable legal exceptions. Deletion requests concerning information independently controlled by third parties should generally be submitted directly to the relevant third party.
20. No Purchase Required
No purchase is required to access the functionality made available through the Application. The Application is free to download and does not offer in-app purchases, and it does not require or permit the purchase of virtual currency or gameplay credits.
If we later introduce paid functionality, such functionality may be governed by additional terms disclosed before purchase.
21. Third-Party Links
The Application may contain links to third-party websites, services, applications, or content. Third-party links are provided for convenience or functionality. We do not control independent third-party services, and your use of third-party services may be governed by separate agreements.
To the maximum extent permitted by law, we are not responsible for third-party content, availability, privacy practices, security, products, services, or transactions between you and independent third parties.
22. Advertisements
The Application does not display third-party advertising or sponsored content. If we ever introduce advertising, its presence will not necessarily constitute endorsement of the advertiser or its products or services, and advertising-related data practices will be addressed in our Privacy Policy.
23. User Feedback
If you provide comments, suggestions, ideas, feature requests, bug reports, or other feedback ("Feedback"), you grant Ontario Golden Falls Casino LTD, to the extent permitted by law, a worldwide, perpetual, irrevocable, royalty-free, non-exclusive right to use that Feedback for purposes including improving the Application, developing new functionality, addressing bugs, developing products, conducting internal research, and operating our services.
You are not required to submit Feedback. This section does not override privacy rights applicable to personal information contained in Feedback.
24. Open-Source Software
The Application may include software components distributed under open-source licenses. Those components remain subject to their applicable open-source license terms. Where an open-source license grants rights that conflict with restrictions in this Agreement, the applicable open-source license controls with respect to that component.
25. Third-Party Software Licenses
Certain components of the Application may be licensed from third parties. Your use of those components may be subject to third-party license terms. Nothing in this Agreement grants broader rights in third-party software than the rights we are authorized to grant.
26. Service Availability
We do not guarantee that the Application will always be available. Availability may be affected by maintenance, server outages, internet failures, hosting issues, software errors, third-party service interruptions, security events, application-store decisions, legal restrictions, compatibility changes, force majeure events, or discontinuation of the Application.
We may temporarily or permanently modify, suspend, or discontinue portions of the Application where permitted by applicable law.
27. Content and Feature Availability
Content and features appearing within the Application may change over time. We may add, remove, replace, or modify content or features, change listings, remove third-party content, restrict content by region, temporarily disable content, or discontinue support for certain content. You do not acquire a permanent right to access any particular piece of content or feature.
28. Technical Malfunctions
The Application and any games or interactive features may experience technical problems including crashes, freezes, loading failures, network interruptions, display errors, graphical errors, interrupted sessions, unavailable games, broken links, incorrect counters, or other software errors.
Because the Application does not provide money, monetary prizes, or redeemable virtual value, technical errors do not create entitlement to compensation, reimbursement, prizes, cash, credits, replacement value, or other monetary claims. We may correct, reset, remove, or modify technical errors.
29. No Warranty
To the maximum extent permitted by applicable law, the Application is provided "AS IS" and "AS AVAILABLE."
Ontario Golden Falls Casino LTD disclaims, to the maximum extent permitted by law, express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, compatibility, security, and uninterrupted operation.
We do not guarantee that the Application will be error-free, that every game will function continuously, that the Application will work on every device, that all third-party games will remain available, that all defects will be corrected, that third-party content will be accurate, or that the Application will meet your expectations.
Mandatory consumer warranties that cannot legally be excluded remain unaffected.
30. No Guarantee of Game Performance
We make no warranty regarding simulated gameplay outcomes. We do not guarantee particular results, specific simulated win frequencies, specific bonus frequencies, particular game behavior, any return-to-player percentage, similarity to real-money games, or particular mathematical probabilities. Demo outcomes are intended solely for entertainment.
31. Limitation of Liability
To the maximum extent permitted by applicable law, Ontario Golden Falls Casino LTD, its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for indirect, special, incidental, consequential, exemplary, or punitive damages arising from or relating to your use of the Application, inability to use the Application, Application downtime, loss of data, interrupted gameplay, third-party content or services, device incompatibility, technical errors, unauthorized access, or reliance on information made available through the Application.
Simulated scores, demo-game balances, counters, outcomes, or gameplay sessions have no monetary value and their loss does not constitute a financial loss. Nothing in this Agreement excludes liability where exclusion is prohibited by applicable law.
32. Liability Cap
To the maximum extent permitted by applicable law, our total aggregate liability arising from or relating to this Agreement or the Application will not exceed the amount you directly paid to Ontario Golden Falls Casino LTD for the Application during the twelve months preceding the event giving rise to the claim.
The Application is provided entirely free of charge and contains no in-app purchases, so the amount paid is nil. Where liability cannot otherwise be excluded or limited, the minimum liability required by applicable law will apply.
33. Consumer Rights
Nothing in this Agreement excludes, restricts, or modifies rights that cannot lawfully be excluded under applicable consumer-protection law. If mandatory consumer law applies to you, those rights remain effective notwithstanding any inconsistent provision of this Agreement.
34. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Ontario Golden Falls Casino LTD, its affiliates, directors, officers, employees, contractors, representatives, and licensors from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Application, your material violation of this Agreement, infringement of another person's rights by you, malicious conduct, or fraudulent use of the Application.
This provision does not apply to the extent prohibited by mandatory consumer law.
35. Termination By You
You may terminate this Agreement at any time by ceasing use of the Application and uninstalling the Application from your devices.
36. Termination By Us
We may suspend or terminate your license to use the Application where reasonably necessary because of violation of this Agreement, illegal activity, abuse of the Application, attempted security breaches, fraudulent activity, interference with our infrastructure, intellectual-property infringement, legal requirements, or discontinuation of the Application.
Where required by applicable law, appropriate notice will be provided.
37. Effect of Termination
When this Agreement terminates, your license to use the Application ends, you must cease unauthorized use of the Application, and you should uninstall the Application where applicable.
Provisions that by their nature should survive termination will remain effective, including provisions regarding intellectual property, ownership, warranties, limitations of liability, dispute resolution, governing law, and accrued legal rights.
38. Changes to the Application
We may change the Application at any time. Changes may include interface updates, new features, removal of features, changes to game listings, compatibility changes, technical modifications, security modifications, branding changes, or changes required by application stores or law. We do not guarantee continued availability of any particular feature.
39. Changes to This Agreement
We may update this Agreement periodically. Updates may reflect Application changes, legal requirements, regulatory developments, security requirements, application-store policies, changes to third-party services, or changes to our business operations.
The "Last Updated" date will indicate when this Agreement was most recently revised. Where applicable law requires notice of material changes, we will provide appropriate notice. Where consent is legally required for an amendment, we will request it. Continued use of the Application after an updated Agreement becomes legally effective constitutes acceptance to the extent permitted by applicable law.
40. Export and Sanctions Compliance
You may not use, export, re-export, or transfer the Application in violation of applicable export-control laws, trade restrictions, economic sanctions, embargoes, or other applicable international trade requirements. By using the Application, you represent that your use is not prohibited under applicable sanctions or export-control laws.
41. Government End Users
If the Application is acquired by or on behalf of a government entity, it is provided as commercial software and commercial computer software documentation to the extent applicable under relevant law. Government users receive only the rights granted under this Agreement unless applicable law requires otherwise.
42. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles, except where mandatory law requires a different result. If you are a consumer, nothing in this section deprives you of mandatory legal protections available in your country or region of residence.
43. Dispute Resolution
Before initiating formal legal proceedings, you and Ontario Golden Falls Casino LTD are encouraged to attempt to resolve disputes informally. You may contact us at support@ontgoldenfallscasino.com.
Unless mandatory law provides otherwise, disputes arising from or relating to this Agreement or the Application will be subject to the competent courts located in Toronto, Ontario, Canada. Consumers may retain the right to bring proceedings in their place of residence where applicable law provides that right.
44. Force Majeure
To the extent permitted by law, we are not responsible for failures or delays caused by circumstances outside our reasonable control, including natural disasters, war, terrorism, civil disorder, government action, internet or electricity failures, telecommunications outages, hosting-provider failures, third-party infrastructure failures, cyberattacks, epidemics, pandemics, labor disputes, or similar events.
45. Assignment
You may not assign or transfer this Agreement or your license without our prior written permission, except where applicable law provides otherwise. We may assign or transfer this Agreement as part of a merger, acquisition, restructuring, financing, sale of assets, corporate reorganization, or transfer of the Application or related business, subject to applicable law.
46. Severability
If any provision of this Agreement is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible. If modification is not possible, the affected provision will be severed. The remaining provisions will continue in effect.
47. No Waiver
Failure by Ontario Golden Falls Casino LTD to enforce a provision of this Agreement does not waive our right to enforce that provision later. No waiver is effective unless legally valid under applicable law.
48. Entire Agreement
This Agreement, together with our Terms and Conditions, Privacy Policy, applicable application-store terms, and any additional terms expressly presented for specific features, constitutes the agreement governing your use of the Application. If there is a conflict between this Agreement and feature-specific terms, the more specific terms will apply to that feature to the extent of the conflict.
49. Relationship With Terms and Conditions
This Agreement primarily governs the license granted to you to use the Application. Our Terms and Conditions govern broader use of the Service and are available at https://ontgoldenfallscasino.com/terms.
Where this EULA and the Terms address the same matter, they should be interpreted consistently wherever reasonably possible. If an unavoidable conflict exists, the provision specifically addressing software licensing will generally control for matters relating solely to the Application license, subject to applicable law.
50. Third-Party Beneficiaries
Except for application-store operators or other parties expressly identified in this Agreement, this Agreement does not create rights in favor of third parties. Any rights of Apple or another application-store provider arise only to the extent required by the applicable store's terms.
51. Language
This Agreement may be translated into multiple languages. The controlling language will be English, to the extent permitted by applicable law. Mandatory local-law requirements remain unaffected.
52. Electronic Acceptance
Your electronic acceptance of this Agreement has the same legal effect as acceptance in writing to the extent permitted by applicable law.
Acceptance may occur through downloading the Application, installing the Application, selecting an acceptance button, accessing the Application, or continuing to use the Application after being presented with this Agreement, as permitted under applicable law.
